Modern Window & Doors, Inc. warrants to you, the Original Property Owner(s) named in this Certificate, that our rigid vinyl window extrusions are free from the manufacturing defects described below. This warranty remains in effect for as long as the Property Owner(s) are living and own an equity interest in the property identified in this Certificate. If more than one Property Owner is named in this Certificate, the warranty shall remain in force as long as at least one of the original Property Owners is living and owns an equity interest in the property in which the windows were installed. Said Warranty applies to the address registered on the warranty card and covers manufacturing defects only. This warranty does not cover installation, labor, or freight

1. Defective parts shall be replaced and delivered free of charge to the installing dealer or homeowner. If in-home service is requested a service charge may be applicable.
   
2. Stress cracks that occur in insulated glass units will be replaced free of charge for a period of one year.
3. Products with exterior painted colors are warranted against flaking, peeling, and fading (acceptable fade rate on vinyl products is 2% per year) for a period of 10 years.
   
4. This warranty only covers the types of damage specified above, and does not include defects or damage attributable to installation, normal weathering, atmosphere pollutants, mildew buildup, or that caused by misuse, abuse, settlement of the building, failure of the structure, the Owner's failure to provide reasonable and necessary maintenance of the product, fire, lightning, tornadoes, hail, vandalism, earthquakes or other acts of God, impact of foreign objects, or other causes beyond the control of Modern Window and Doors, Inc.

Condensation on windows, which may occur as the natural result of humidity within the property, and changes in interior/exterior temperatures, does not indicate a defect in window and is not included in this Warranty.

Modern Window and Doors, Inc. reserves the right to discontinue or make changes in any of its products. If the products in this Warranty are not available, Modern Window and Doors, Inc. shall have the right to substitute a product that, in Modern Window and Doors, Inc.'s sole discretion, is of equal quality or value.

ANY IMPLIED WARRANTIES IMPOSED BY LAW, SUCH AS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN TIME TO THE DURATION OF THIS EXPRESS WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. MODERN WINDOW AND DOOR, INC. SHALL NOT BE LIABLE TO YOU FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF ANY EXPRESS, WRITTEN, ORAL, OR IMPLIED WARRANTY ON THE WINDOW. YOUR EXCLUSIVE REMEDY SHALL BE REPAIR OR REPLACEMENT, SOLEY AT MODERN WINDOW AND DOOR, INC.'S OPTION, AND ONLY ON THE TERMS STATED IN THE CERTIFICATE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

THIS WARRANTY SHALL BE VALID ONLY AFTER THE REGISTRATION CERTIFICATE ATTACHED TO THIS WARRANTY IS FILLED IN BY THE AUTHORIZED DEALER, SIGNED BY THE ORIGINAL PURCHASER AND MAILED BY CERTIFIED MAIL, RETURN RECEIPT REQUESTED, TO THE UNDERSIGNED WITHIN THIRTY (30) DAYS AFTER COMPLETION OF INSTALLATION.

RETURN OF REGISTRATION CERTIFICATE IS A CONDITION PRECEDENT TO COVERAGE UNDER THIS WARRANTY.
